Sec. 760.8. Failure to implement an application

The failure, neglect or refusal of an applicant for the establishment of a new certified home health agency to obtain a certificate of approval and commence operation of the certified home health agency within one year of issuance of the Public Health Council's approval or contingent approval of the application shall constitute an abandonment of the application by the applicant and any approval or contingent approval issued by the Public Health Council shall be deemed cancelled and withdrawn without further action of such council.
