Sec. 26.3. Types of licenses

- The following types of licenses are hereby prescribed for independent adjusters pursuant to section 2108 of the Insurance Law:(a) Independent adjuster, fire.The independent adjuster, fire, shall have authority to investigate and adjust all claims arising under policies of fire insurance, miscellaneous property damage insurance, water damage insurance and collision insurance.(b) Independent adjuster, inland marine.The independent adjuster, inland marine, shall have authority to investigate and adjust all claims arising under policies of inland marine insurance.(c) Independent adjuster, aviation.The independent adjuster, aviation, shall have authority to investigate and adjust all claims arising under policies of aviation insurance.(d) Independent adjuster, automobile.The independent adjuster, automobile, shall have authority to investigate and adjust all claims arising under policies of motor vehicle insurance, including automobile personal injury liability insurance and property damage liability insurance, automobile collision insurance, insurance covering the theft of automobiles and comprehensive automobile insurance.(e) Independent adjuster, motor vehicle no-fault and workers' compensation health service charges.The independent adjuster, motor vehicle no-fault and workers' compensation health service charges, shall have authority to investigate and adjust all claims for health service charges arising under policies of mandatory and/or additional personal injury protection insurance (no- fault); and workers' compensation insurance.(f) Independent adjuster, automobile damage or theft appraisals.The independent adjuster, automobile damage or theft appraiser, shall have authority to appraise and adjust all claims arising under automobile physical damage coverages. For claims arising under property damage liability insurance policies, the authority of any adjuster licensed under this subdivision is limited to appraisal of damage to automobiles.(g) Independent adjuster, casualty.The independent adjuster, casualty, shall have authority to investigate and adjust all claims arising under policies of personal injury and property damage liability insurance, burglary and theft insurance, glass insurance, workers' compensation and employer's liability insurance, boiler and machinery insurance, elevator insurance, credit insurance, animal insurance, collision insurance, legal services insurance, and water damage insurance, but shall not include the investigation and adjustment of losses of motor vehicle and aircraft insurance as specified under subdivisions (c) and (d) of this section.(h) Independent adjuster, fidelity and surety.The independent adjuster, fidelity and surety, shall have authority to investigate and adjust all claims arising under bonds or undertakings of a fidelity and surety insurer.(i) Independent adjuster, accident and health.The independent adjuster, accident and health, shall have authority to investigate and adjust all claims arising under policies of accident and health insurance.(j) Independent adjuster, general.The independent adjuster, general, shall have authority to investigate and adjust all claims arising under policies of insurance as specified under subdivisions (a) through (g) of this section.(k) Independent adjuster, multi-peril crop insurance.The independent adjuster, multi-peril crop insurance, shall have authority to investigate and adjust all claims arising under policies of multi-peril crop insurance that are reinsured by the Risk Management Agency, an agency of the United States Department of Agriculture.
