The purpose of this Part is to establish rules for the implementation of article 78 of the Insurance Law, as enacted by chapter 638 of the Laws of 1993. This Part sets forth requirements pertaining to licensing of viatical settlement companies and viatical settlement brokers, viatical settlement contracts, reporting, examination, marketing, advertising, disclosure and rules applicable to insurers which will facilitate viatical settlement transactions.
