Sec. 45-6.5. Operations

  • (a) Manuals. Each owner of a go-kart track shall have available for review by the commissioner written maintenance and operational manual.
    (1) Maintenance manual. The requirements of section 45-1.11(b) of this Part shall apply to both the go-karts and the go-kart track. In addition to the requirements of section 45-1.11(b) of this Part, this manual shall include written procedures for:
    (i) brake adjustments and service;
    (ii) steering linkage adjustment and service;
    (iii) wheel alignment adjustment and service;
    (iv) tire inflation pressures;
    (v) wheel nut torque values;
    (vi) grade of all fasteners;
    (vii) torque value or tightening instruction on all fasteners;
    (viii) wear and lubrication points including lubricants used;
    (ix) frame inspection points;
    (x) passenger restraint system and adjustment;
    (xi) passenger capacity by weight;
    (xii) maximum vehicle operating speeds;
    (xiii) all installation, operating, and maintenance manuals or service bulletins which are provided by go-kart manufacturer or its component suppliers;
    (xiv) fuel system inspection procedure;
    (xv) service and adjustment procedure for all components of the go-kart; and
    (xvi) schedule of components requiring periodic maintenance.
    (2) Operational manual. Each go-kart location having one or more go-kart tracks shall develop a written operational manual, which shall contain procedures for:
    (i) operator job descriptions;
    (ii) proper fueling of go-karts;
    (iii) dealing with emergency situations; and
    (iv) equipment operations.
    (b) Warning to passengers and patrons. Each owner of a go-kart track shall post at the entrance to the track, at the pit area, and at the ticket booth a warning sign as required by section 870-e of the Labor Law. In addition to section 870-e this warning shall include the following warnings and instructions:
    (1) patrons must obey all instructions given by the operator;
    (2) bumping of go-karts is prohibited;
    (3) loose clothing and long hair shall be secured;
    (4) restraining devices shall be left on;
    (5) passengers shall remain in the go-kart until told to leave by the attendant; and
    (6) smoking in the go-kart, pit, or any other posted area is prohibited.
    (c) Directional signs. Signs indicating the direction of travel shall be posted in the pit and other locations on the go-kart track as deemed necessary.
    (d) Daily inspections. The requirements of section 45-2.7 of this Part shall apply separately to each go-kart and go-kart track.
    (e) Control and operation. All go-karts and go-kart tracks shall be operated in accordance with the manual required in subdivision (a) of this section and the owner shall:
    (1) authorize each operator to take action to prevent unsafe operation;
    (2) provide sufficient number of staff to insure proper operation of the facility; and
    (3) train staff in the proper operation of the facility as provided in subdivision (a) of this section.
    (f) Maximum speed. Each go-kart track shall have a maximum speed. The owner shall ensure that a go-kart cannot be operated in excess of the maximum speed. This speed shall be established by the go-kart track designer based on the following conditions:
    (1) track design and grade;
    (2) track surface;
    (3) radius of curves;
    (4) age of riders;
    (5) go-kart manufacturer's recommendations; and
    (6) minimum height of passengers.
    (g) Fire protection. All fire extinguishers shall be serviced annually. Each go-kart track shall have as a minimum one 15 lb. BC rated fire extinguisher in each of the following locations:
    (1) pit area;
    (2) refueling area; and
    (3) garage.
