(a) Section 7.09 of the Mental Hygiene Law grants the Commissioner of Mental Health the power and responsibility to adopt regulations that are necessary and proper to implement matters under his/her jurisdiction.
(b) Sections 7.37 and 7.38 of the Mental Hygiene Law grant the Commissioner of Mental Health the authority to set forth a process for placement of individuals in receipt of transitional care funding and to set standards which guarantee the right to administrative review and a hearing regarding placements of individuals receiving transitional care funding.
