(a) Section 7.09 of the Mental Hygiene Law grants the Commissioner of Mental Health the power and responsibility to adopt regulations that are necessary and proper to implement matters under his/her jurisdiction.
(b) Section 41.49 of the Mental Hygiene Law authorizes the Commissioner of Mental Health to promulgate rules and regulations for the operation and funding of programs that expand the existing community based system of mental health services or create new services for children with serious emotional disturbance.
