(a) Issuance of an operating certificate by OPWDD shall be dependent upon the facility meeting environmental standards prescribed by the Department of Health for medical treatment and health-related services which are provided to individuals whether or not they have a developmental disability.
(b) A waiver may be obtained from OPWDD for requirements of medical and health-related services which are not appropriate to the individuals served or are provided through a contractual agreement by another agency.
