Some municipalities and public authorities receive State transportation assistance funds through municipalities, public authorities or State agencies other than the New York State Department of Transportation. Such funds, unless disbursed by the New York State Thruway Authority on behalf of the New York State Department of Transportation, shall not be included in determining whether this Part applies to the municipality or public authority. Such funds shall be treated for the purposes of this Part as a procurement activity.
