Such traffic signal shall be installed by the property owner under a permit issued by the department if it is located at a private road or driveway. Operation and maintenance of the signal will be done by the department for an annual fee to be charged to the permittee. Operation and maintenance of signals erected prior to April 1, 1986 may be done by the permittee under the terms of the existing maintenance agreement or by the department for an annual fee, at the department's discretion.
