- In determining qualifications and fitness of an applicant for original licensure pursuant to article 27 of the New York General Business Law, the secretary shall conduct a review of factors unrelated to prior criminal history, including, but not limited to:(a) findings of violations related to any provision of article 27 or any regulation adopted thereunder;(b) findings of unlicensed practice of nail specialty, waxing, natural hair styling, esthetics or cosmetology;(c) findings of failure to pay taxes or of tax liens; and(d) findings of failure to pay child support.
