Sec. 1208-1.1. Introduction and purpose

  • (a) Section 381 of the Executive Law authorizes the Secretary of State to promulgate rules and regulations prescribing minimum standards for administration and enforcement of the Uniform Fire Prevention and Building Code (the Uniform Code) and the State Energy Conservation Construction Code (the Energy Code). This Part includes that portion of the rules and regulations promulgated pursuant to section 381 of the Executive Law that relates to: 1) qualifications of staff, including requirements for certification of such staff, and 2) minimum basic training and in-service training requirements for personnel charged with administration and enforcement of the Uniform Code and/or the Energy Code. This Part shall apply to personnel who work for local governments, counties or State agencies that administer and enforce the Uniform Code and/or the Energy Code.
    (b) Section 376-a of the Executive Law authorizes the Secretary of State to promulgate rules and regulations relating to training of personnel charged with enforcement of the Uniform Code and/or the Energy Code, including, but not limited to, rules and regulations relating to code enforcement training programs for such code enforcement personnel; the minimum courses of study, attendance requirements, and equipment and facilities required for such code enforcement training programs; the qualifications for instructors for such code enforcement training programs; requirements of minimum basic training which code enforcement personnel must complete in order to be eligible for continued employment or permanent appointment and the time within which such basic training must be completed; and requirements for in-service training programs and advanced in-service training programs for code enforcement personnel. This Part includes the rules and regulations promulgated by the Secretary of State pursuant to section 376-a of the Executive Law.
