Sec. 150.2. Voluntary program

The New York State Department of Agriculture and Markets shall provide service for a voluntary program for the production of virus-tested plant materials.

(a) Application for participation in the program shall be made annually on forms provided by the department, and participation is subject to approval by the commissioner.

(b) Application period.

New applications for the years following the date of promulgation of this Part must be made during the month of January or February of such year to be eligible for participation during that year. Any renewal applications must be made during the month of December of the preceding year of the year of participation.

(c) Fees, set by the commissioner, shall be required to defray partial costs of these services. Remittance of the appropriate fee shall be submitted annually as directed by the commissioner for participation in the program.
