Sec. 371.3. Preliminary and final notices of intent

- (a) Preliminary notice of intent. State agencies, public benefit corporations and local governments shall file a preliminary notice of intent, in the form prescribed by this Part, with the commissioner and the county agricultural and farmland protection board as early as possible in the development of a proposal of an action, but in no event later than the date of any determination as to whether an environmental impact statement need be prepared for the action pursuant to article 8 of the Environmental Conservation Law.(b) Final notice of intent. State agencies, public benefit corporations and local governments shall file a final notice of intent, in the form prescribed by this Part, with the commissioner and the county agricultural and farmland protection board at least 65 days prior to undertaking an action within an agricultural district.
