Sec. 2371.3. Designation and duties of the privacy compliance officer

  • The records access officer, as designated by the Commissioner of Taxation and Finance pursuant to section 2370.2 of this Title, is hereby designated privacy compliance officer. The privacy compliance officer shall:
    (1) coordinate the department's and the Tax Commission's response to requests for amendment or correction of records, with due regard, however, upon all occasions to the secrecy provisions enumerated in the Tax Law;
    (2) provide information and assistance to a data subject concerning the nature and location of records and systems of records which may contain personal information identifiable to such data subject, with due regard, however, upon all occasions to the secrecy provisions enumerated in the Tax Law; and
    (3) have the power to appoint, from personnel from within the department, a deputy or deputies, according to need, to assist him in the coordination of responses to requests for access to and/or amendment or correction of personal records.
