Sec. 1160.4. General provisions governing commercial ground transportation service

  • (a) Access to airport.
    All commercial ground transportation operators are required to obtain authorization from the NFTA in order to have access to the airport property for the purpose of providing the transport of persons or property to or from the terminal in a commercial vehicle. In order to obtain said authorization, a commercial ground transportation operator must apply to the NFTA for an access permit and must pay the NFTA the established fees and charges. Access permits are issued either in the form of a coupon granting the operator a one-time access privilege or a decal, which is valid for a specified time period.
    (b) Solicitation.
    No person engaged in providing commercial ground transportation service at the airport may solicit business at the airport or within the terminal premises, except to the extent expressly authorized by the NFTA. For purposes hereof, neither the leasing of a telephone call panel or other advertising display from the NFTA or its representative, nor activities in compliance with the NFTA's meet and greet policy, as set forth herein at section 1160.17 of this Part, shall be deemed to constitute solicitation.
    (c) Fees and charges.
    It shall be the policy of the NFTA to establish and assess appropriate fees and charges to be paid by commercial ground transportation operators. The fees and charges for nonconcessionaire commercial ground transportation operators will be established by tariff, as set forth in section 1160.21 of this Part and will be reviewed periodically and adjusted from time to time.
    (d) Rules and regulations.
    Commercial vehicles shall strictly comply with all laws and local ordinances which affect in any way the actions of those engaged in performing commercial ground transportation at the airport, laws of the State of New York, rules and regulations of the New York State Department of Transportation applicable to the operations contemplated herein and rules and regulations of the NFTA applicable to said operator. Further, commercial ground transportation operators will procure or cause to be procured all licenses, insurance, permits, and pay all fees therefore necessary for the conduct of operations contemplated by this policy.
