Sec. 510.16. Notice to the capital defender office

- (a) Upon a determination of the Court of Appeals affirming a judgment that includes a sentence of death, the clerk of the Court of Appeals shall notify the capital defender office of the determination by the end of business on the day such determination is handed down.(b) Notice to the capital defender office required pursuant to subdivision (a) of this section shall consist of telephone, facsimile, electronic mail or other prompt electronic means of communication, which shall be followed by first class mail notification within two business days after the affirmance.(c) The clerk of the Court of Appeals shall retain a written record of the electronic and written notice given pursuant to subdivision (b) of this section.
