(a) CPL 450.70(1) mandatory appeal.
A timely appeal must be taken pursuant to CPL 460.10(1). In addition, counsel for defendant must file one copy of the notice of appeal, with proof of service and filing, with the clerk of the Court of Appeals.
(b) Other capital appeals.
Any other appeal in a case involving a sentence of death shall be taken by the timely service and filing of a notice of appeal pursuant to CPL 460.10(1). In addition, counsel for appellant must file one copy of the notice of appeal, with proof of service and filing, with the clerk of the Court of Appeals.
