Sec. 219-8.3. Compliance schedules

  • (a) Compliance schedule for Class I units.
    (1) Submit a final control plan to the department's appropriate regional air pollution control engineer for review and approval within three months after the effective date of EPA's approval of New York State's Small Municipal Waste Combustor State Plan (State Plan) or by August 6, 2003, whichever is earlier.
    (2) Award contracts for emission control systems or for process modifications, or issuance of orders for the purchase of component parts to accomplish emission control or process modification within nine months after the effective date of EPA's approval of the State Plan or by February 6, 2004, whichever is earlier.
    (3) Initiate on-site construction or installation of emission control equipment or process changes within 15 months after the effective date of EPA's approval of the State Plan or by August 6, 2004, whichever is earlier.
    (4) Complete on-site construction or installation of emission control equipment or process changes within 34 months after the effective date of EPA's approval of the State Plan or by October 6, 2005, whichever is earlier.
    (5) Achieve full compliance with approved final control plan and requirements of Federal 40 CFR 60, subpart BBBB (dated December 6, 2000) as incorporated under section 200.10 of this Title and this Subpart, as applicable, with 36 months after the effective date of EPA's approval of the State Plan or by December 6, 2005, whichever is earlier.
    (b) Compliance schedule for Class II units.
    (1) Submit a final control plan to the department's appropriate regional air pollution control engineer for review and approval within three months after the effective date of EPA's approval of New York State's Small Municipal Waste Combustor State Plan (State Plan) or by September 6, 2003, whichever is earlier.
    (2) Achieve full compliance with the approved final control plan and requirements of Federal 40 CFR 60, subpart BBBB (dated December 6, 2000) as incorporated under section 200.10 of this Title and this Subpart, as applicable, within one year after the effective date of EPA's approval of the State Plan or by December 6, 2005, whichever is earlier.
