Sec. 80-2.2. General requirements

  • (a) The requirements for the permanent certificate shall be those in effect at the time the provisional certificate for the certificate title sought is issued.
    (b) The requirements set forth in Subpart 80-1 shall be applicable unless the subject matter or terms of such requirements prescribe otherwise.
    (c) The requirements for extensions or annotations of teachers' certificates set forth in Subpart 80-4 of this Part shall be applicable for candidates who apply for extensions or annotations on or after February 2, 2004. The requirements for extensions or annotations of teachers' certificates set forth in this Subpart shall be applicable for candidates who apply for extensions or annotations of teachers' certificates on or before February 1, 2004, and who upon such application qualify for such extensions or annotations.
    (d) Validation and comparability of licenses granted for the city school districts of New York and Buffalo.
    (1) A license issued pursuant to the Education Law by the superintendent of schools of the city school district of Buffalo or, prior to February 14, 1991, by the chancellor of the city school district of the City of New York shall be valid for service in any school district in the State for which a comparable State certificate is required, provided such license has been issued upon qualifications which are at least substantially equivalent to those required for such certificate pursuant to these regulations. Except as provided in paragraph (2) of this subdivision, comparability of the State certificate pursuant to this Part and the license granted by such school districts shall be determined by the commissioner.
    (2) In accordance with Education Law, section 2569(a), the following tables set forth the licenses utilized by the city school district of the City of New York and the corresponding State certificate titles:

    (e) Provisional certification through certification by other states.
    Candidates who apply for a provisional certificate in a certificate title prescribed in this subdivision on or before February 1, 2004 may apply for such certification pursuant to the requirements of this subdivision.
    (1) For provisional certification in a certificate title in the classroom teaching service for which this Part requires completion of an examination requirement, the commissioner may issue to a candidate who has not met such examination requirement a two-year nonrenewable conditional provisional certification, notwithstanding that the examination requirement has not been met, and deem that all other requirements for the provisional teacher's certificate in the certificate title in the classroom teaching service have been met, provided that the candidate holds a valid regular teacher's certificate in the same or an equivalent title by a state which has contracted with the State of New York pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel, and provided further that such regular teacher's certificate issued by the other state evidences knowledge, skills, and abilities comparable to those required for certification in New York State. For individuals called to active duty with the Armed Forces, the two-year nonrenewable conditional provisional may be extended by the commissioner for the time of active service and an additional 12 months from the end of such service. To meet the requirements for a full provisional certificate in such certificate title, the candidate shall be required to submit to the commissioner, at least 60 days prior to the expiration of the conditional provisional certification, satisfactory evidence of meeting the examination requirement for the provisional certificate title sought, as prescribed in this Part. If the candidate meets such examination requirement, the commissioner shall issue a provisional certificate for the term commencing on the day after the expiration date of the conditional provisional certificate and ending five years after the effective date of the conditional provisional certificate. This paragraph shall not apply to a candidate who holds a temporary license to teach in a professional position in the classroom teaching service on or after March 8, 2000.
    (2) For provisional certification in a certificate title in the classroom teaching service for which this Part does not require completion of an examination requirement, the commissioner may deem that all requirements for the provisional teacher's certificate in the classroom teaching service have been met by a candidate who holds a valid regular teacher's certificate in the same or an equivalent title by a state which has contracted with the State of New York pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel, provided that such regular teacher's certificate issued by the other state evidences knowledge, skills, and abilities comparable to those required for certification in New York State.
    (3) The commissioner may deem that all requirements for a provisional teacher's certificate in a title in the classroom teaching service have been met by a candidate who holds a valid teacher's certificate in the same or an equivalent title issued by any state and also holds a certificate in the same or an equivalent title issued by the National Board for Professional Teaching Standards.
    (4) A candidate may meet the educational preparation requirements for a provisional certificate in a certificate title prescribed in this Part by successfully completing a program of educational preparation for a teacher's certificate in such certificate title or its equivalent at an institution of higher education approved pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel. In order to be eligible for a provisional certificate such candidates shall be required to meet all other requirements for the provisional certificate as prescribed in this Part, which may include but are not limited to an examination requirement.
    (5) A candidate who meets provisional certification requirements through meeting the requirements of this subdivision shall be required to meet the regular requirements for permanent certification set forth in this Part.
