Sec. 122.9. Canvassing of military ballots

- (a) The appropriate school board of education or the school district public library, as applicable, shall canvass all military ballots:(1) received by it before the close of the polls on election day and showing a cancellation mark of the United States postal service or a foreign country’s postal service, or showing a dated endorsement of receipt by another agency of the United States government; or(2) received by it not later than 5:00 p.m. on election day and signed and dated by the military voter and one witness thereto, with a date which is ascertained to be not later than the day before the election.(b) Inspectors of election shall thereafter process military ballots in the same manner as provided in Education Law sections 2018-a and 2018-b for the canvassing of non-military ballots.
