Part 7421. Access to Legal Services |
Sec. 7421.1. Policy

- (a) Residents placed in a secure facility operated by the Office of Children and Family Services (OCFS) shall be allowed access to legal services for the purpose of:(1) legal preparation with respect to any civil action or proceeding relating to the resident’s conditions of confinement or criminal action or proceeding; and(2) at the discretion of the facility director, or person acting in that capacity, legal preparation with respect to any matter.(b) Consistent with the requirements of this Part, OCFS shall develop written policies and procedures that govern residents’ access to legal services. These policies and procedures shall be reviewed annually and updated as needed.(c) As used in this subtitle, legal services shall include access to:(1) legal counsel; and(2) the Ombudsman.
