Sec. 138.4. General provisions governing eligibility for reimbursement

- (a) Reimbursement for moving and travel expenses shall not be granted if:(1) the distance between the old and new places of employment, as measured over the shortest distance along public highways, is less than 35 miles; or(2) the employee's place of residence at the time of transfer, reassignment or promotion is located at a distance, as above measured, less than 35 miles from the new place of employment; or(3) the employee was previously reimbursed for moving and travel expenses for a previous move during the 12 months preceding the date of transfer, reassignment or promotion; or(4) the transfer, reassignment or promotion was effective prior to July 1, 1961; or(5) the employee moved prior to July 1, 1961.(b) For purposes of determining if a change in assignment is the result of a transfer, reassignment, or promotion, the employee's permanent position at his old location shall be compared with the position for which he is paid at his new location.
