Sec. 152.9. Nonapplicable situations

Notwithstanding any of the foregoing provisions of this Part, the provisions of this Part shall not apply to the following:
(a) officers or employees paid on a fee-schedule basis;
(b) officers or employees whose salaries are prescribed by section 40, 60 or 169 of the Executive Law;
(c) officers or employees in collective negotiating units established pursuant to article 14 of the Civil Service Law;
(d) employees allocated to salary grades the salary of which is determined by application of the salary schedule contained in paragraph b of subdivision 1 of section 130 of the Civil Service Law.
