Sec. 177.14. Notification to ombudsman of youth's need for legal counsel

  • (a) The facility or program director shall immediately notify the office of the ombudsman whenever it comes to his/her attention that a youth under his/her care:
    (1) has been or is about to be arrested by a law enforcement official;
    (2) has been served with the order of a court, a subpoena or a summons; or
    (3) is in need of legal counsel.
    (b) Whenever a youth has been or is about to be arrested by a law enforcement official, the ombudsman shall take steps to insure that the youth is provided with adequate legal representation.
    (c) When a youth is to be interrogated or interviewed by a law enforcement official concerning a criminal act, or by any person concerning a civil or criminal matter, the ombudsman may request to be present during such interrogation or interview; however, the ombudsman shall not serve as the youth's attorney or legal representative.
