PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Public Service Commission is considering a petition by New York State Electric and Gas Corporation for a waiver or modification of provisions in two of its Non Rate Economic Development Programs.
Statutory authority:
Public Service Law, sections 5(1)(b), 65(1), (2), (3), 66(1), (3), (5), (10), (12) and (12-b)
Subject:
NYSEG's procedures, terms and conditions of its Targeted Financial Assistance Program.
Purpose:
Provide additional economic development program assistance for a new manufacturing facility.
Substance of proposed rule:
The Public Service Commission is considering a petition filed by New York State Electric and Gas Corporation requesting a waiver for the provisions of its Targeted Financial Assistance and Natural Gas Infrastructure Investment Programs which would allow the Company to provide a grant, from its accumulated economic development reserve fund, to a new manufacturing facility having appreciable economic merit. The Commission may adopt, reject or modify the petition, in whole or in part, the relief proposed and may address any related matters.
