    Notice of Abandoned Property Received by the State Comptroller
    Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. A list of the names and last known addresses of the entitled owners of this abandoned property is maintained by the office in accordance with Section 1401 of the Abandoned Property Law.     Department of State F-2011-1041 (DA) Date of Issuance - January 18, 2012
    The New York State Department of State (DOS) is required by Federal law to provide timely public notice for the activity described below, which is subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
    The United States Environmental Protection Agency, has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
    In F-2011-1041 DA, the U.S. Environmental Protection Agency has published for review, two draft National Pollutant Discharge Elimination System (NPDES) permits for discharges "incidental to the normal operation of vessels." If finalized, the re-issuance of the Vessel General Permit (VGP) would authorize discharges "incidental to the normal operation" of non-military and non-recreational vessels equal to or greater than 79 feet in length and would replace the current VGP issued in December 2008 and expiring on December 18, 2013. The proposed draft Small Vessel General Permit (sVGP) would authorize discharges "incidental to the normal operation" of non-military and non-recreational vessels less than 79 feet in length. These permits will apply to the waters "of the United States," defined as those waters extending to the outer reach of the 3 mile territorial sea, as defined in section 502(8) of the CWA.
    Information regarding these permits can also be obtained at: www.regulations.gov under Docket ID No. EPA-HQ-OW-2011-0141 for the VGP, and Docket ID No. EPA-HQ-OW-2011-0150 for the sVGP.
    Any interested parties and/or agencies desiring to express their views concerning the above proposed activity may do so by filing their comments, in writing, no later than 4:30 p.m., 30 days from the date of publication of this notice, or February 17, 2012.

    Pursuant to 15 CFR 923.84(b), the New York State Department of State (DOS) has submitted a routine program implementation action to the federal Office of Ocean and Coastal Resource Management (OCRM). The DOS considers this action to be routine and has requested OCRM's concurrence in this determination. The change to the NYS Coastal Management Program (CMP) covered by this request is the removal of National Marine Fisheries Service (NMFS) Fisheries Management Plans (FMPs) from the list of "Direct Federal Activities and Development Projects Likely to Affect New York State's Coastal Area" (Table 2) of the CMP.
    Table 2 was revised as a part of routine program implementation change in 2006 to the New York State Coastal Management Program, which was originally approved by the U.S. Department of Commerce, Office of Coastal Zone Management in September of 1982. Part I of this table pertains to direct federal activities and development projects and includes National Marine Fisheries Management Service (NMFS) Fisheries Management Plans (FMPs). Although the plans would be removed from Table 2 of the CMP, federal consistency provisions still will still apply to FMPs. As an unlisted action, DOS will monitor the activities of NMFS and notify them of any proposed FMPs which the State feels may have reasonably foreseeable coastal effects and may require a Federal consistency determination.
    There will be no changes to the enforceable policies of the CMP as a result of this RPC. The purpose of this notice is to specifically solicit comments on whether or not the change to Table 2 of the CMP constitutes a routine program implementation under the Coastal Zone Management Act of 1972, as amended.
    Any comments on whether or not the action constitutes a routine program implementation should be submitted within three weeks of the date of this Notice to Joelle Gore, Acting Chief, Office of Ocean and Coastal Resource Management, Coastal Programs Division, N/ORM3, SSMC4, 11th Floor, 1305 East-West Highway, Silver Spring, MD 20910.

    The Department of State announces the availability for public review and comment of New York State's revised draft Section 309 Combined Assessment and Strategy for 2011 - 2015. The Combined Assessment and Strategy is a public document, prepared by the State's Coastal Management Program (CMP) for approval by the National Oceanic and Atmospheric Administration (NOAA) in order for the State to be eligible for federal Section 309 funding in FY2011-2015.
    The document is presented in two parts: an assessment section which describes the current status and associated accomplishments by the State in each of nine federal 'priority enhancement areas' (Wetlands, Coastal Hazards, Public Access, Marine Debris, Cumulative and Secondary Impacts, Special Area Management Planning, Ocean/Great Lakes Resources, Energy and Government Facility Siting, and Aquaculture); and a section which articulates the strategies the Department plans to pursue over the next five years using federal Section 309 funds. Revisions to the original November 2010 document include: the deletion of a strategy to establish a direct permit program; deletion of a marine debris strategy; and deletion of a strategy for a NYS Coastal Management Program amendment for the Atlantic Ocean and Great Lakes. These programmatic revisions are a result of changes in the State's coastal resource management priorities since the November 2010 document was submitted to NOAA for approval.
    Revisions were also made to the budget established in the document. The budget for the strategy titled Update the Significant Habitat Program was revised downward to more accurately reflect the staff time that will be involved in that effort. The budgets for the remaining strategies (Develop Ecosystem-scale Local Waterfront Revitalization Programs; Develop a NYS Coastal Management Program Amendment for Long Island's South Shore Estuary) were revised to reflect what is anticipated will be an increased amount of staff time necessary for their implementation. The five year budget summary and table of contents have been revised to reflect all of the above identified changes.
    The revised draft Section 309 Combined Assessment and Strategy is available for review at http://nyswaterfronts.com/index.asp. Comments on the draft document should be sent in writing via e-mail to coastal@dos.state.ny.us. Please type 'Comments on Draft 309 Assessment and Strategy' in the e-mail's subject line. Comments are due no later than Friday February 17, 2012.
