PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition from Rochester Gas and Electric Company (RG&E) and Cayuga Energy, Inc. (Cayuga) requesting that a plan for divestiture of generation facilities they own be terminated or modified.
Statutory authority:
Public Service Law, sections 2(2-b), (4), (13), 5(1)(b), 65(1), (2), (3), 66(1), (3), (5), (10) and 70
Subject:
Termination or modification of a plan for divestiture of generation facilities owned by RG&E and Cayuga.
Purpose:
Consideration of termination or modification of a plan for divestiture of generation facilities owned by RG&E and Cayuga.
Substance of proposed rule:
The Commission is considering a petition from Rochester Gas and Electric Company (RG&E) and Cayuga Energy, Inc. (Cayuga) dated December 29, 2010 requesting that a plan providing for the divestiture of generation facilities they own be terminated or modified. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
