    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    The commission, on Dec. 13, 2006, concerning several petitions for rehearing and/or clarification of its Aug. 23, 2006 order adopting recommended decisions with modifications.
    Statutory authority:
    Public Service Law, section 22
    Subject:
    New York State Electric and Gas Corporation's rates and services.
    Purpose:
    To consider several petitions for rehearing and/or clarification of the commission's order of Aug. 23, 2006.
    Substance of final rule:
    The Commission adopted an order in response to several petitions for rehearing and/or clarification of its August 23, 2006 order, and decided to reaffirm without change its prior decisions, except to modify the order to set a date by which New York State Electric & Gas Corporation must give notice of its intent to offer fixed price commodity service in 2008; and to clarify the order to state that EOSA customers will not pay a merchant function charge, subject to the terms and conditions set forth in the order.

    No changes.
