PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering whether to approve, deny or modify, in whole or in part, a petition by The Champlain Telephone Company for approval to file an amendment to the company's certificate of incorporation with the New York Department of State.
Statutory authority:
Public Service Law, section 108(1)
Subject:
Filing of certificate of amendment to a certificate of incorporation.
Purpose:
Approval of the filing of a certificate of amendment to a certificate of incorporation with the New York Department of State.
Substance of proposed rule:
The Commission is considering whether to approve, deny or modify, in whole or in part, a petition by The Champlain Telephone Company (company) for approval to file an amendment to the company's certificate of incorporation with the New York Department of State, occasioned by the proposed creation of an Employee Stock Ownership Plan. The Commission may approve, reject or modify, in whole or in part, the relief requested by The Champlain Telephone Company.
