NOTICE OF PUBLIC HEARING
Insurance Department
The New York State Insurance Department will conduct public hearings in New York City, Long Island, Albany, and Rochester to gather information about the life settlement industry to help ascertain the scope of oversight and regulation needed to protect insurance policyholders in New York State.
The large-scale purchase of life insurance policies began with the onset of the AIDS epidemic more than two decades ago. In recent years, however, a life settlement market has expanded to include purchases of life insurance policies where the insured does not have a catastrophic or life-threatening illness or condition. The insureds generally are senior citizens, who use the market as an opportunity to obtain a monetary benefit greater than the cash surrender value but less than the death benefit of the policy. In some cases, potential buyers also have financed the purchase of life insurance policies solely for the purpose of resale. Interests in these purchased policies often are resold to third party investors, who achieve the best investment returns upon an insured’s early death. Reports indicate that the business of purchasing beneficial interests in life insurance policies is currently an estimated $15 billion dollar industry nationwide.
These purchases of life insurance policies, often packaged for resale to investors, currently are outside the scope of the Insurance Law and are essentially unregulated. These transactions raise fundamental concerns about the privacy rights of policyholders and insureds (particularly where the policies are resold), the lack of transparency regarding commissions paid to brokers and others, and the possible use of deceptive solicitation practices to obtain ownership of, or a beneficial interest in, life insurance policies owned by residents of New York State.
The purpose of the hearings is to gather information from policyholders and insureds who have been solicited to or who have entered into these transactions, and to hear any concerns that such persons have about protection of their private information or deceptive sales practices, and to seek advice from consumer groups and advocates regarding their concerns and observations about the industry.
The Department seeks input from the general public, senior citizen organizations, and consumer groups with experience or expertise regarding life settlements. Oral and written testimony should focus on consumer experience with life settlement contracts and the acquisition of life insurance policies for the purpose of resale.

New York State Energy Reseach and Development Authority
On December 17, 2008 the New York State Energy Research and Development Authority (“NYSERDA”) will be participating in a regional auction for the sale of carbon dioxide allowances under the Regional Greenhouse Gas Initiative (“RGGI”) in accordance with the CO2 Allowance Auction Program (Title 21 NYCRR Part 507). The auction will be conducted on December 17, 2008 from 9 a.m. ET until 12 p.m. ET. In this auction, NYSERDA will be making available for sale 12,422,161 vintage 2009 New York allowances. All parties are eligible to participate in this auction provided they become qualified and meet all other participation requirements. Applications for participation are due October 30, 2008. In F-2008-0586 (entitled "Joseph Licciardi and Catherine Pino"), Costello Marine Contracting Corporation, the applicants' authorized agent, is proposing the installation of a rock revetment along a previously undisturbed length of shoreline of a residential lot in the Town of Southold, Suffolk County, adjacent to Orient Harbor to control the erosive forces of wave action.
Specifically, the applicant has applied to the U.S. Army Corps of Engineers for authorization and proposes the following:
• Backfill the existing eroded areas and re-grade the existing slope as needed to facilitate the installation of the proposed revetment, utilizing approximately 70 cubic yards of "trucked-in" clean fill.
• Construct a 4'-5' tall by 95' long rock revetment that utilizes geotextile fabric, a 25-50 pound hardcourse stone foundation and individually stacked 500-1,000 pound stones.
• Repair and replace in-kind and in-place an existing stairway.

The installation of a series of French Drains upland of the bulkhead, within spring high water, to control excess ground water from natural springs, with associated drainage to be piped through the bulkhead into Hempstead Harbor. The replacement of one set of davits and a ladder. The placement of a total of 260cy of clean fill to be placed on-site, 20cy of which will be placed below spring high water at low areas behind the bulkhead and 5cy below spring high at the timber steps area. The planting of 12 Rosa rugosa plants in the filled wash out areas as mitigation. The above activity has been stated as necessary due to hardship of the upland boat shelter, garage, native plant area and soft soil from springs in the low grade area landward of the bulkhead.
