    Department of Health
    Pursuant to Chapter 365 of the Laws of 2007, the Commissioner of Health has the authority to designate nationally-recognized accrediting agencies to accredit office-based surgery practices. Therefore, the Department of Health hereby gives notice of the following:
    Section 230-d of the Public Health Law requires that all office-based surgery practices, as that term is defined in the statute, must become accredited by July 14, 2009, by a nationally-recognized accrediting agency designated by the Commissioner. The Department of Health is now accepting letters of application for designation by the Commissioner, from any nationally-recognized accrediting agency that accredits office-based surgery practices. Letters of applications must be submitted no later than November 15, 2007, in order to be eligible for the initial designation of accrediting agencies by the Commissioner. Applications may be submitted after November 15, 2007, but will not be eligible for the Commissioner's initial designation.

    Higher Education Services Corporation Program Evaluation Services for NY GEAR UP
    The New York State Higher Education Services Corporation (HESC) is the state's Lead Agency for the state-level Gaining Early Awareness and Readiness for Undergraduate Program (GEARUP). NYGEAR UP is funded through a federal grant awarded to HESC by the U.S. Department of Education (ED). GEAR UP is an early intervention and college awareness program that encourages eligible low-income students to graduate from high school, prepare for, and graduate from college. HESC was awarded an initial GEAR UP grant for multiple years beginning in 1999 and has been awarded a second GEAR UP grant for the period of September 1, 2005 to August 31, 2011. Program evaluation is a U.S. Department of Education (ED) requirement.
    HESC made awards to eleven (11) sub-grantees that represent a total of eleven (11) project sites that directly administer the program to eligible students. In addition, HESC made awards to six (6) state partners that provide support services to the sub-grantee project sites and students.
    HESC will issue a Request for Proposals (RFP) to acquire the program evaluation services needed to meet federal requirements for measuring the effectiveness and efficiency of the program in terms of the progress achieved for the students served. Bidders proposals must include the services of a Principle Evaluator to be assigned to this engagement who has experience managing a minimum of one summative (or similar) evaluation as well as experience in performing ongoing annual evaluations of a GEAR UP Program (or other similar program) of comparable size/scope.

    The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
    The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at 41 State Street in Albany, New York.
    In F-2007-0731, Keyspan Generation, LLC of 175 East Old Country Road, Hicksville, NY 11801 is proposing the installation of sand-filled geotextile tubes placed just offshore of the Northport Power Plant discharge canal. These geotubes, deployed in a modified chevron design, seek to channelize the flow from the plant's discharge canal, seaward away from the shoreline. The objectives of the project are to reduce the entrainment of thermally enriched discharge water into the plant's intake lagoon and to reduce the amount of dredging that is needed within the intake lagoon. By reducing the entrainment of discharge water into the intake lagoon, the applicant seeks to reduce the amount of water used for cooling in the power plant. Further, the project seeks to limit the amount of sediment moving into the intake lagoon, located approximately 1,000 feet west of the discharge canal, thus reducing the amount of dredging in this area.
    Any interested parties and/or agencies desiring to express their views concerning the above proposed activity may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, October 18, 2007.

    In F-2007-0734, The Department of Homeland Security, Plum Island Animal Disease Center, P.O. Box 848, Greenport, NY 11944, is proposing the dredging of Orient Point Harbor. The proposed work would include the hydraulic dredging of approximately 18,000 cubic yards of material from the Orient Point Harbor, with the spoils pumped directly to two upland disposal sites adjacent to the harbor. A portion of the material would be used to nourish an existing spit on site, and the remainder would be made available to the New York State Office of Parks, Recreation and Historic Preservation for use at the Orient Beach State Park and as stockpile for future emergency use. The proposed dredging is necessary to allow the continued use of the harbor for passenger and freight ferries used for accessing the Plum Island Animal Disease Center research facility.
