    Waiver of the Requirements of 16 NYCRR, Part 96 to Permit Project Construction As Designed
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Public Service Commission is considering whether to grant, deny or modify, in whole or part, the petition filed by Concern for Independent Living for waiver of the requirements of 16 NYCRR, Part 96 to permit project construction as designed.
    Statutory authority:
    Public Service Law, sections 2, 4(1), 30, 32-48, 52, 53, 65(1), 66(1), (2), (3), (4), (12) and (14)
    Subject:
    Waiver of the requirements of 16 NYCRR, Part 96 to permit project construction as designed.
    Purpose:
    To consider the request for waiver from 16 NYCRR, Part 96, by Concern for Independent Living for 815 E. NY Ave., Brooklyn, NY.
    Substance of proposed rule:
    The Public Service Commission is considering to grant, deny or modify, in whole or part, the petition filed by Concern for Independent Living for waiver of the requirements of 16 NYCRR, Part 96 to permit project construction as designed for 815 East New York Avenue, Brooklyn, New York, located in the territory of Consolidated Edison Company of New York, Inc.
