    Administration of Ability-to-Benefit Tests for Eligibility for Awards and Loans
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    Addition of section 145-2.15 to Title 8 NYCRR.
    Statutory authority:
    Education Law, sections 207 (not subdivided), 215 (not subdivided) and 661(4); and L. 2007, ch. 57, part E-1, sections 1 and 2
    Subject:
    Administration of ability-to-benefit tests for eligibility for awards.
    Purpose:
    To identify certain ability-to-benefit tests and the passing scores for such tests that the Board of Regents approves for purposes of eligibility for awards under section 661 of the Education Law. The proposed amendment also establishes criteria that the department will utilize to determine if an approved ability-to-benefit test is independently administered; in order to implement the requirements of L. 2007, ch. 57.
