    Amendment of Part 590, Payment of Expenses Upon Acquisition of Real Property to Comply with the Marriage Equality Act
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    Amendment of Part 590 of Title 6 NYCRR.
    Statutory authority:
    Environmental Conservation Law, sections 3-0301 and 3-0305
    Subject:
    Amendment of Part 590, Payment of Expenses Upon Acquisition of Real Property to Comply with the Marriage Equality Act.
    Purpose:
    To ensure regulations are gender neutral to comply with the Marriage Equality Act.
    Substance of final rule:
    The proposed amendments to 6 NYCRR Part 590 have been made to comply with the Marriage Equality Act which requires changing terms such as “husband” to “person”. Other words have been changed to reflect gender neutrality.
    Final rule as compared with last published rule:
    Nonsubstantive changes were made in sections 590.8(a) and 590.9(c).

    Revised Job Impact Statement
    A job impact statement is not submitted with the proposal because there will be no adverse impact on existing or future jobs and employment opportunities. The non-substantive revisions to the express terms were made so that the regulation would be gender neutral.
