    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    Amendment of Appendix(es) 1 of Title 4 NYCRR.
    Statutory authority:
    Civil Service Law, section 6(1)
    Subject:
    Jurisdictional classification.
    Purpose:
    To delete positions in the exempt class and to classify positions in the exempt class in the Executive Department.
    Text of final rule:
    Amend Appendix(es) 1 of the Rules for the Classified Service, listing positions in the exempt class, in the Executive Department under the subheading “Office for Technology,” by deleting therefrom the position Deputy Director (2), by adding thereto the position of Counsel and by increasing the number of positions of NYS Deputy Chief Information Officer from 1 to 5.
    Final rule compared with proposed rule:
    Nonsubstantive changes were made: Paragraph should read: by deleting therefrom the position of Deputy Director (2), by adding thereto the position of Counsel and by increasing the number of positions of NYS Deputy Chief Information Officer from 1 to 5.
