PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition by CPV Valley, LLC for approval of a lightened regulatory regime and financing in connection with a natural gas electric generating facility with a nominal rating of 630 MW in the Town of Wawayanda, New York.

Substance of proposed rule:
The Public Service Commission (Commission) is considering a petition filed on October 14, 2010, from CPV Valley, LLC, requesting approval of a lightened regulatory regime and financing in connection with a natural gas electric generating facility with a nominal rating of 630 MW in the Town of Wawayanda, New York. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
