    Transfer of Controlling Interests in Generation Facilities from Dynegy to PSEG
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering a request for the approval of the transfer, from Dynegy Holdings LLC (Dynegy) to PSEG Resources LLC (PSEG), of controlling interests in the Roseton and Danskammer electric generation facilities.
    Statutory authority:
    Public Service Law, sections 2(11), 5(1)(b) and 70
    Subject:
    Transfer of controlling interests in generation facilities from Dynegy to PSEG.
    Purpose:
    Consideration of the transfer of controlling interests in electric generation facilities from Dynegy to PSEG.
    Substance of proposed rule:
    The Public Service Commission is considering a petition filed on November 8, 2011 requesting approval of the transfer, from Dynegy Holdings LLC to PSEG Resources LLC (PSEG), of controlling ownership interests in Dynegy Danskammer LLC and Dynegy Roseton LLC, the lessors and operators of, respectively, the approximately 500 MW Danskammer and 1,220 MW Roseton fossil-fueled electric generation facilities located in Newburgh, NY. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
