    Modification of the RPS Customer-Sited Tier Category Funding Allocations and Schedule of Collections
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering whether to adopt, modify, or reject, in whole or in part, potential modifications to the Renewable Portfolio Standard (RPS) program funding allocations for the Customer-Sited Tier and schedule of collections.
    Statutory authority:
    Public Service Law, sections 4(1), 5(2), 66(1) and (2)
    Subject:
    Modification of the RPS Customer-Sited Tier category funding allocations and schedule of collections.
    Purpose:
    To reallocate, enhance or diminish funding in the RPS program/Customer-Sited Tier in light of current circumstances.
    Substance of proposed rule:
    The Commission is considering whether to adopt, modify, or reject, in whole or in part, potential modifications to the Renewable Portfolio Standard (RPS) program funding allocations for the Customer-Sited Tier and schedule of collections. The Customer-Sited Tier funds renewable resource projects for solar photovoltaic systems, fuel cells, anaerobic digestion biogas systems, and small wind turbines. Based on experience to date, it has been difficult to predict the level of demand for these resources on a month-to-month basis. The Commission is considering whether to reallocate, enhance or diminish funding in the RPS program/Customer-Sited Tier, in whole and by category, in light of current circumstances. The Commission is also considering whether any such changes will require modification to the schedule of collections of RPS funds from ratepayers.
