The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for non-institutional services to revise provisions of the Ambulatory Patient Group (APG) reimbursement methodology on or after January 1, 2016. The following changes are proposed:
The Ambulatory Patient Group (APG) reimbursement methodology is revised to include recalculated weight and component updates that will become effective on or after January 1, 2016. The estimated annual net aggregate increase in gross Medicaid expenditures attributable to this initiative contained in the budget for state fiscal year 2015/2016 is $317,339.
The public is invited to review and comment on this proposed State Plan Amendment. Copies of which will be available for public review on the Department’s website at http://www.health.ny.gov/regulations/state_plans/status.

Long Island Power Authority and PSEG Long Island
On December 15, 2015, pursuant to New York Public Authorities Law Section 1020-f(cc), the Long Island Power Authority (Authority) and PSEG Long Island filed with the New York State Department of Public Service (Department) an emergency response plan (2016 Electric Emergency Response Plan for PSEG Long Island (Plan)) to assure the reasonably prompt restoration of service in the case of a storm or other cause beyond the control of the Authority and PSEG Long Island. The Plan was prepared in accordance with Section 66(21)(a) of the New York State Public Service Law (PSL) and the regulations of the Public Service Commission adopted thereunder.
Subject to review and recommendation by the Department in accordance with PSL Section 3-b(3)(c), the Authority may adopt, amend, or reject the Plan, in whole or in part.
Copies of the Plan are posted on the website of the Long Island Power Authority (http://www.lipower.org/); the website of PSEG Long Island (https://www.psegliny.com/); and the website of the New York State Department of Public Service (Matter number 15-02577). Department of State F-2015-0682 Date of Issuance – December 30, 2015
The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue, in Albany, New York.
In F-2015-0682, or Collins Enterprises, LLC a/k/a “Hudson River Esplanade”, the applicant is proposing to rehabilitate 150 linear feet of an existing walkway and timber bulkhead and to construct and additional 150’ structure in order to connect with an adjacent public esplanade and the Habirshaw Park. The stated project purpose is to improve and facilitate public thoroughfare along the waterfront. The applicant anticipates that the proposed plan “will allow continuous public access to the waterfront from the Habirshaw Park in the north to Sculpture Park in the south, approximately 3,100 linear feet of shoreline”.
The proposed Esplanade would be a total of twenty feet wide to accommodate pedestrian and bicycle traffic, with half of the structure spanning over the water and half situated on the existing shoreline. This is an estimated over water extension of ten feet waterward from the existing structural shoreline and results in a covering (or permanent loss) of approximately 3,000 square feet of water surface area which is currently exposed, viable aquatic habitat, and a publicly accessible resource. The over water coverage may also occupy state-owned underwater lands – a public trust resource. The Esplanade design will span over two existing outfall pipes, avoiding interruption or conflict with their use.
As the site fronts the Yonkers Paddling and Rowing Club, an existing floating dock and gangway will be removed during construction and replaced in its current condition. The existing bulkhead will be replaced with a gabion wall system. The applicant states that this proposed replacement will include vegetated areas and plantings throughout the public areas for environmental and aesthetic purposes.
The proposed activities would be undertaken within and adjacent to the State-designated Significant Coastal Fish and Wildlife Habitat (SCFWH) unit of the Lower Hudson Reach.
