    PUBLIC NOTICE
    Department of State F-2013-0629 Date of Issuance–December 4, 2013
    The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
    The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue, in Albany, New York.
    In F-2013-0629, Goomer Hollow, LLC is proposing the repair of dam infrastructure. The project site, known as the Holy Cross Dam, is situated approximately at 243 Morton Road in the Town of Rhinebeck, New York.
    According to the information provided to the Department of State, the project entails rehabilitation of an existing dam structure which has breached and the undertaking of various additional activities. The proposed scope of work exceeds the existing dam footprint and includes: placement of fill material (approximately 9,206 square feet) within adjacent wetland, impacting approximately 0.21 acres of the federal jurisdictional wetland; dredging/excavation of accumulated sediment (approx. 2,800 cubic yards) and removal of an additional 9,000 cubic yards of material to create a refuge pool -- resulting in a deepening of the pond basin; planned upland disposal of dredged materials in a mowed field area; installation of a 10′ x 10′ floating dock; installation of a 6′ x 30′ fixed dock; repair of existing bridge abutments and piers; and installation of geothermal utility lines underground from the pond to the existing residence. The project is cited by the applicant as necessary to secure the dam for safety reasons and to allow the dam to function as originally constructed. The site may contain historic structures.
    The proposed activities would be undertaken within the Local Waterfront Revitalization Program (LWRP) planning area for the Town of Rhinebeck. Activities under federal permitting authority within this planning are subject to review for their consistency with the local program and its policies. Local LWRP review is under the purview of the Town of Rhinebeck’s Conservation Advisory Board (CAB). The work site is also located within a Town designated Priority Conservation Area, as identified by the Town of Rhinebeck’s adopted Comprehensive Plan.
    Any interested parties and/or agencies desiring to express their views concerning any of the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 30 days from the date of publication of this notice or January 04, 2014.

    The New York State Department of State (DOS) is required by Federal law to provide timely public notice for the activity described below, which is subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
    The United States.S. Department of Interior – National Parks Service (NPS) has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
    In F-2013-0849 (DA), the U.S. Department of Interior – National Parks Service (NPS) is proposing to perform maintenance and recovery dredging of the existing federal marinas and navigation channel known as Sailor’s Haven Marina, Talisman/Barrett Beach and Marina and Watch Hill Marina within the Fire Island National Seashore.
    The Environmental Assessment submitted by NPS with their consistency determination identifies the following preferred alternative for each site:
    Sailor’s Haven: An estimated 4,000 to 10,000 cubic yards (cy) of material is proposed to be dredged and will be placed behind bulkheads to restore elevations, as well as along the eastern and western shorelines as beach nourishment/sediment transport.
    Talisman/Barrett Beach: Approximately 10,000 cy of material is proposed to be dredged and will be placed along the eastern and western shorelines as beach nourishment/sediment transport.
    Watch Hill: Approximately 35,000 cy of material is proposed to be dredged and placed upland as stockpile, used to raise elevations in heavily used public areas, or placed along the beach at the Sailor’s Haven and/or Talisman/Barrett Beach as beach nourishment/sediment transport.

    In F-2013-0891, Indian Town Association, Mud Creek, Old Saybrook, CT, is proposing to perform maintenance dredging of approximately 24,500 cy from the existing facility and navigation channel. The proposal is for mechanical dredging with un-confined placement of the silty fine grained material at the Central Long Island Sound Disposal Site (CLIS) and nearshore placement of the sandy material at Hammonasset Beach, Madison, CT. The CLIS is an open-water disposal site located within Long Island Sound, approximately 5.6 nautical miles south of East Haven, CT.
