    Lightened Regulation by Marble River, LLC
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed action:
    The Public Service Commission is considering whether to approve or reject, in whole or in part, the petition of Marble River, LLC (Marble River) for an order providing for lightened regulation.
    Statutory authority:
    Public Service Law, sections 4(1), 66(1) and 110
    Subject:
    Marble River's request for lightened regulation as an electric corporation.
    Purpose:
    To consider the request in connection with the development of the Marble River Project, a wind-powered generating facility.
    Substance of proposed rule:
    By petition filed November 7, 2007, Marble River, LLC seeks a Certificate authorizing its wind energy project in Clinton County pursuant to § 68 of the Public Service Law. It also seeks an order adopting a rule providing for lightened regulation of it as an electric corporation.
