    Criminal History Record Review
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    Amendment of Part 550 of Title 14 NYCRR.
    Statutory authority:
    Mental Hygiene Law, sections 7.09 and 31.35; and Executive Law, section 845-b(h)(12)
    Subject:
    Criminal history record checks.
    Purpose:
    To implement OMH's statutory duty to facilitate requests for criminal background record checks, which are required by law as of April 1, 2005. This law is intended to protect mental health clients from risk of abuse or being victims of criminal activity. The regulations are necessary to implement the law as of its effective date so that we can fulfill our statutory imposed duty of ensuring the health, safety, and welfare of clients are not unreasonably placed at risk.
