Approval of a Transfer of Ownership Interests in a Generation Facility

PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:

Proposed Action:

The Public Service Commission is considering a petition from EPCOR Power (Castleton) LLC and Castleton Energy Center LLC requesting approval of a transfer of ownership interests in a 67 MW generation facility.

Statutory authority:

Public Service Law, section 70

Subject:

Approval of a transfer of ownership interests in a generation facility.

Purpose:

Consideration of approval of a transfer of ownership interests in a generation and facility.

Substance of proposed rule:

The Public Service Commission is considering a petition from EPCOR Power (Castleton) LLC (EPCOR) and Castleton Energy Center LLC (CEC) requesting approval of a transfer of ownership interests, from EPCOR to CEC, in a 67 MW generation facility located in Castleton, New York. CEC also requests that lightened regulation of the facility and its owners continue after the transfer is consummated. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
