    Asset Sale Gain Account by New York State Electric & Gas Corporation
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    The commission, on Jan. 17, 2007, adopted the terms and provisions of an Oct. 26, 2006 joint proposal, and directed New York State Electric & Gas Corporation (NYSEG) to refund customers $77.1 million from its asset sale gain account (ASGA).
    Statutory authority:
    Public Service Law, sections 2(13), 5(1)(b), 66(1), (12-a) and 107(1)
    Subject:
    Distribution of $77.1 million from NYSEG's ASGA to its customers.
    Purpose:
    To approve the distribution.
    Substance of final rule:
    The Commission adopted the terms and provisions of an October 26, 2006 joint proposal, and directed New York State Electric & Gas Corporation to refund its customers $77.1 million from its Asset Sale Gain Account, subject to the terms and conditions of the order.

    No changes.
