    Fixed Gas Costs by Orange and Rockland Utilities, Inc.
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed action:
    The Public Service Commission is considering whether to approve or reject, in whole or in part, a proposal filed by Orange and Rockland Utilities, Inc. (O&R) to make various changes in the rates, charges, rules and regulations contained in its schedule for gas service, P.S.C. No. 4, to become effective June 1, 2007.
    Statutory authority:
    Public Service Law, section 66(12)
    Subject:
    Fixed gas costs.
    Purpose:
    To change the methodology for determining the fixed percentages used to allocate fixed and balancing service costs between O&R and Consolidated Edison Company of New York, Inc. and establish a process to update these fixed percentages on an annual basis.
    Substance of proposed rule:
    The Commission is considering Orange and Rockland Utilities, Inc.'s (O&R's) request to change the methodology for determining the percentages used to allocate the fixed gas costs and balancing service costs between O&R and Consolidated Edison Company of New York, Inc. and to establish a process to update the percentages on at least an annual basis. The Commission may approve, reject or modify, in whole or in part, O&R's request.
