PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The Public Service Commission is considering a petition filed by the City of Jamestown Board of Public Utilities seeking approval to recover a deferral amortization of maintenance costs, as approved in the commission's March 21, 2007 order in Case 06-E-1577, from the dismantling fund set aside in the commission's Sept. 29, 2005 order in Case 04-E-1485. The commission may accept, reject, or modify, in whole or in part, the recovery requested.

Public Service Law, sections 5(1)(b), 65(1), 66(1), (5), (9) and (12)
Subject:
Uniform system of accounts—request for recovery of deferral amortization.
Purpose:
To allow the City of Jamestown Board of Public Utilities to recover the second year of a deferral amortization.
