PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:

Action taken:

Notice of proposed rule making, I.D. No. ENV-43-06-00008-P, has been withdrawn from consideration. The notice of proposed rule making was published in the State Register on October 25, 2006.

Subject:

The Department of Environmental Conservation (Department) proposes to amend 6 NYCRR Part 200, General Provisions by modifying the definition of “Nonattainment Area” at 6 NYCRR 200.1(av).

Reason(s) for withdrawal of the proposed rule:

The proposed rule is being withdrawn to remove references to the 8-hour ozone non-attainment designations as a result of the United States Court of Appeals For the District of Columbia Circuit decision dated December 22, 2006.
