    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Public Service Commission is considering whether to approve, deny or modify, in whole or in part, a petition filed by Niagara Mohawk Power Corporation for approval to use the GE/Dresser Model 5 transfer prover, with 20M and 5M reference standards.
    Statutory authority:
    Public Service Law, section 67(1)
    Subject:
    Whether to permit the use of the GE/Dresser Model 5 transfer prover with 20M and 5M reference standards.
    Purpose:
    Whether to approve the use of tthe Model 5 transfer prover, with 20M, and 5M reference standards.
    Substance of proposed rule:
    The Public Service Commission is considering whether to grant, deny or modify, in whole or part, the petition filed by Niagara Mohawk Power Corporation, to use the GE/Dresser Model 5 transfer prover with 20M and 5M reference standards. This test standard will be used to determine the performance of commercial and industrial gas meters in New York State.
