    Approval of the Emergency Action on a Permanent Basis
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    On 3/27/14, the PSC adopted an order approving on a permanent basis, an emergency action allowing Helios Power Capital LLC to assume from Dynegy Danskammer LLC, the responsibility of notification of the retirement of the 530 MW Danskammer Generation Station.
    Statutory authority:
    Public Service Law, sections 5(1)(b), 65(1), (2), (3), 66(1), (3), (5), (8), (10) and 70
    Subject:
    Approval of the emergency action on a permanent basis.
    Purpose:
    To approve the emergency action on a permanent basis.
    Substance of final rule:
    The Commission, on March 27, 2014, adopted an order approving the emergency action on a permanent basis to substitute Dynegy Danskammer, LLC with Helios Power Capital, LLC as the entity responsible for filing notice that the retirement of the 530 MW Danskammer Generation Station, and established further procedures, subject to the terms and conditions set forth in the order.
