PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a complaint from AG-Energy, L.P. asking that just and reasonable rates, terms and conditions be established for the gas transportation service provided to it by St. Lawrence Gas Corporation.
Statutory authority:
Public Service Law, sections 64, 65(1), (2), (3), 66(1), (3), (5) (10) and (12)
Subject:
Just and reasonable rates for gas transportation service.
Purpose:
Establishing just and reasonable rates for gas transportation service.
Substance of proposed rule:
The Public Service Commission is considering a complaint from AG-Energy, L.P. asking that just and reasonable rates, terms and conditions be established for the gas transportation service provided to it by St. Lawrence Gas Corporation, and that it be determined a gas transportation contract between the two entered into pursuant to Service Classification No. 5 is no longer just and reasonable. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
